Abstract

We studied judiciary independence through elements of judgement independence and guaranties, by analyzing the judiciary independence obstacles। This study shows a mechanism to achieve such independence through several elements. Firstly, the independence of al-qadaa is toward the legislative authourity and confronting the executive authority, the public opinion and journalism. Secondly, judgement independence of the judge himself / herself has also been targetted. Hiad al-qadi and his / her vituousness to the judgement independence should be guaranteed.
